Terms and Conditions

These Terms and Conditions ("Terms") apply to your use of mydanicare.com (the "Website") and to text messages and emails you receive from DaniCare Psychiatry ("DaniCare," "we," "us"). By using the Website or submitting a form on it, you agree to these Terms. If you do not agree, please do not use the Website.

1. In an emergency

If you or someone you know is having a medical or mental health emergency, please get help right away:

• Call 911.
• Call or text 988, the Suicide & Crisis Lifeline (free, 24/7, with Spanish-language support).
• Go to the emergency department of the nearest hospital.

2. Website information is not medical advice

Content on the Website, including blog articles, symptom checklists and self-assessments, is general educational information. It is not a diagnosis, medical advice or a substitute for an evaluation by a qualified clinician. Do not start, stop or change any medication based on information on the Website.

3. No patient relationship until care begins

Submitting a form, requesting an appointment or sending us a message does not make you a DaniCare patient. A clinician-patient relationship begins only after you complete our intake process and attend your first appointment. We may decline to schedule care when another type of service would better meet your needs, and we will try to point you to appropriate resources.

4. Telehealth

We provide some services by secure video. For a telehealth visit, you must be physically located in a state where your clinician is licensed (currently Texas, California, New Jersey or New York) at the time of the visit. You are responsible for joining from a private location and for having a working device and internet connection. Telehealth has limits: your clinician may ask you to be seen in person when that is needed for your care. Prescriptions, including controlled substances, are issued only when clinically appropriate and allowed by federal and state law. No prescription is guaranteed.

5. Text message (SMS) program

If you opt in on our forms, DaniCare may send you text messages about appointment requests, scheduling, reminders and practice updates.

• Message frequency: up to 5 messages per month.
• Cost: message and data rates may apply, depending on your mobile plan.
• To stop: reply STOP at any time. You will receive one confirmation message and no further texts.
• For help: reply HELP, or call us at (956) 266-8476.
• Consent to receive texts is not a condition of receiving care.
• Mobile carriers are not liable for delayed or undelivered messages.
• We do not sell or share your mobile number or text-message consent with third parties for their marketing.

Text messages and regular email are not fully secure. Please do not send detailed health information by text or email. Use our patient portal or call us instead.

6. Appointments, cancellations and payment

Please give us at least 24 hours' notice if you need to cancel or reschedule. We prefer that you call us at (956) 266-8476 to cancel or reschedule, because a phone call is the fastest way to make sure we receive your request. You are responsible for providing accurate insurance information and for any copays, deductibles or charges your plan does not cover. Coverage depends on your plan, and we recommend confirming your benefits with your insurer before your visit.

7. Your responsibilities

You agree to give accurate information on our forms, to use the Website only for lawful purposes, and not to interfere with the Website's security or operation. If you submit a form on behalf of a minor, you confirm that you are the minor's parent or legal guardian or are otherwise authorized to act for them.

8. Privacy

How we collect, use and protect your information, including protected health information under HIPAA, is explained in our Privacy Policy. If these Terms and the Privacy Policy conflict on a privacy matter, the Privacy Policy controls.

9. Website content and links

The Website's text, logos, graphics and design belong to DaniCare Psychiatry or its licensors and may not be copied or reused without permission, except for personal, non-commercial use. The Website may link to outside websites, such as government health sources. We do not control those sites and are not responsible for their content.

10. Disclaimers and limitation of liability

We work to keep the Website accurate and available, but it is provided "as is," without warranties of any kind, and we do not guarantee that it will be error-free or uninterrupted. To the fullest extent allowed by law, DaniCare is not liable for any indirect or consequential damages arising from your use of the Website. Nothing in these Terms limits any rights you have as a patient under applicable law, or any liability that cannot be limited by law.

11. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

12. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. Continuing to use the Website after a change means you accept the updated Terms.
